Conformity of the goods
The good that the entrepreneur delivers or supplies to the consumer or user is in conformity with the contract when a series of subjective and objective requirements are fulfilled and provided that it has been correctly installed.
Right of the consumer and user in case of lack of conformity of the goods
The trader shall be liable to the consumer or user for any lack of conformity that exists at the time of delivery of the goods, and the consumer or user may, by means of a simple declaration, demand that the trader remedy this lack of conformity, reduce the price or terminate the contract. In any of these cases, the consumer or user may also demand compensation for damages.
Warranty period
The legal guarantee period for goods shall be 2 to 3 years from the time of delivery. In the case of second-hand properties, a shorter period may be agreed, but in no case may it be less than one year from the time of delivery.
Presumption of lack of conformity
In the absence of proof to the contrary, lack of conformity which becomes apparent within 2 years of delivery of the good shall be presumed to have existed when the good was delivered. Previously the period was 6 months.
Warranty period for repairs
The employer shall be liable for the lack of conformity that motivated the conformity during the year following (previously the period was 6 months) the delivery of the good already in conformity, it being presumed that it is the same lack of conformity when the defects of the same origin as those initially manifested are reproduced.
Prescription of the action to demand the liability of the employer
The limitation period for bringing an action for non-conformity of purchased goods shall expire 5 years after the occurrence of the non-conformity. Previously the period was 3 years.
Repair and after-sales services
The producer shall guarantee, in any case, the existence of an adequate technical service, as well as spare parts for a minimum period of 10 years from the date on which the goods cease to be manufactured. Previously the period was 5 years.
